Monsters dont only drop items from their level. This is to reduce the overall number of higher lvl rares, making them more rare.
sure, it may suck to get a lower lvl rare off a higher lvl mob, but the ecenomy will be better for it. Keep on at it and eventually you will get a lvl 9 item
Jon, I remember a specific post direct towards you that told you that idea isn't being implemented. And why are you talking as if you know how things works? You are consistently wrong. Ask if you aren't sure, but don't post misinformation as if you are sure.

Cloak of Magi IS a level 9 rare. 400 INT can do wonderful things: but if you have a reasonable argument to why the cloak is underpowered take it to the suggestions forum where it'll be considered by the community. The game isn't perfectly balanced, thats for sure
